1. Acceptance of these Terms

These Terms of Service ("Terms") govern your use of Ayn, an online marketplace operated by TeqBooster. By creating an account or using Ayn, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Ayn.

2. What Ayn does

Ayn helps customers find and book independent photographers. Photographers are independent professionals, not employees or agents of Ayn. When a customer books a photographer, the agreement for the photography service is between the customer and the photographer. Ayn is not a party to that agreement and does not provide photography services.

Payment for photography services is made directly between the customer and the photographer. Ayn does not collect, hold or process these payments and takes no commission.

3. Accounts

• You must be at least 18 years old.
• The information you give must be accurate and kept up to date, and you must verify your email address.
• You are responsible for keeping your password secure and for all activity on your account.
• You may not create an account for someone else without their permission, or create a new account to get around a suspension.

4. For customers

• Using Ayn to find and book photographers is free.
• A booking request is only a request until the photographer confirms it.
• Give accurate booking details, including the location and your phone number.
• Be on time and respectful, and cancel as early as possible if your plans change.
• Agree any details or extras beyond the package directly with the photographer.

5. For photographers

• Your profile, packages, prices and photos must be accurate and truthful.
• You must own, or have the right to use, every photo in your portfolio.
• Keep your working hours up to date, respond to requests promptly, and honour confirmed bookings or cancel with reasonable notice and a clear reason.
• You are responsible for your own services, equipment, taxes, permits, insurance and compliance with applicable laws.

6. Photographer subscriptions

To appear on Explore, photographers need an active plan or free trial. Prices are shown on Ayn in US dollars and may change; a change will not affect a period you have already paid for.

• The free trial is offered once per account.
• At this time, plans are paid by manual transfer and activated after we confirm the payment. Plans do not renew automatically.
• When a plan ends, your profile is hidden from Explore until you renew. Your data is kept.
• Paying early adds the new period after your current period ends.
• Fees are non-refundable, except where required by law or where we decide otherwise at our discretion.

7. Content and reviews

You keep ownership of the content you add to Ayn, such as photos, descriptions and messages. You give Ayn a worldwide, non-exclusive, royalty-free licence to host, display, copy, resize and share that content as needed to operate and promote Ayn, for as long as it remains on Ayn.

Reviews must be honest, based on a real completed booking, and must not contain insults, personal data or misleading claims. We may hide reviews or any other content that breaks these Terms.

8. Prohibited conduct

You must not:

• Give false information or impersonate anyone.
• Post stolen, illegal, offensive or sexually explicit content.
• Harass, threaten or discriminate against anyone.
• Commit fraud or create fake bookings or fake reviews.
• Use Ayn to send spam or advertise unrelated services.
• Try to access other accounts, disrupt Ayn, scrape its data or overload it.
• Get around a suspension or any security measure.

9. Reports, suspension and termination

You can report a user you have a booking with. We review reports and may warn, restrict, suspend or permanently block any account that breaks these Terms or puts others at risk, and we may cancel related open bookings. You can stop using Ayn at any time and ask us to delete your account through our contact page.

10. Disclaimers

Ayn is provided "as is" and "as available". We do not guarantee that Ayn will always be available or free of errors. We do not verify every detail users provide, and we do not guarantee the quality, safety or legality of services offered by photographers, or the conduct of any user. Please use good judgement before booking or meeting anyone.

11. Limitation of liability

To the fullest extent permitted by law, Ayn and TeqBooster are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from agreements, services, payments or disputes between customers and photographers. Our total liability to you for any claim related to Ayn is limited to the amount you paid us in the twelve months before the claim, or US$100 if you have paid us nothing. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to indemnify Ayn and TeqBooster against any claims, losses and expenses arising from your content, your services or bookings, or your breach of these Terms or the law.

13. Disputes between users

If you have a problem with a booking, first try to solve it directly with the other party through the chat in Ayn. We may help where we can, but we are not responsible for resolving disputes between users.

14. Changes to Ayn and to these Terms

We may change or discontinue features of Ayn at any time. We may also update these Terms; we will post the new version here, update the date above and tell you about significant changes. By continuing to use Ayn after changes take effect, you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which TeqBooster operates, and the competent courts of that jurisdiction will handle any dispute, unless the law of your country gives you mandatory rights that say otherwise.
